Welcome to MakePhotosAlive. The terms "we", "us" and "our" refer to MakePhotosAlive. MakePhotosAlive operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). MakePhotosAlive is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.
SECTION 2 - OUR PRODUCTS
MakePhotosAlive provides a digital photo restoration and animation service. You upload old or damaged photos and we return colorized, restored, and animated video files delivered to your email address. Results are delivered within 30 minutes for most orders and within 2 hours for larger orders.
We have made every effort to accurately represent our service. However, the quality of results may vary depending on the condition, resolution, and clarity of the photos you upload. We do not warrant that results will meet every expectation or that every photo will produce optimal output. Photos with very low resolution, extreme damage, or no visible faces may produce lower quality results.
All service descriptions are subject to change at any time without notice at our sole discretion.
SECTION 3 - ORDERS
When you place an order you are making an offer to purchase. MakePhotosAlive reserves the right to accept or decline your order for any reason. Your order is not accepted until payment is confirmed.
By placing an order you agree to upload photos that you own or have the legal right to use. You must not upload photos of individuals without their consent or the consent of their legal representatives. You must not upload any content that is illegal, offensive, or violates the rights of any third party.
Your purchases are subject to our Refund Policy. We offer a 30-day money back guarantee on all orders.
SECTION 4 - PRICES AND BILLING
Prices are displayed in the currency shown at checkout and are subject to change without notice. The price charged will be the price in effect at the time the order is placed as shown in your order confirmation.
You agree to provide current, complete and accurate payment information for all purchases. You represent and warrant that the payment information you provide is true, correct, and complete and that you are authorized to use the payment method provided.
SECTION 5 - DIGITAL DELIVERY
MakePhotosAlive is a fully digital service. No physical products are shipped. Your animated video files are delivered as download links sent to the email address provided at checkout. Download links remain active for 30 days from the date of delivery. We are not responsible for emails that are blocked by spam filters or for download links that expire due to inaction.

SECTION 6 - PHOTO UPLOADS AND YOUR CONTENT
You retain full ownership and copyright of all photos you upload. By uploading photos you grant MakePhotosAlive a limited, temporary license to process those photos solely for the purpose of fulfilling your order.
Your uploaded photos and output video files are permanently deleted from our servers within 30 days of your purchase. We do not use your photos to train AI models, for advertising, or for any purpose other than fulfilling your order.
You represent and warrant that you own or have the legal right to use all photos you upload and that your use of the service does not violate any applicable law or the rights of any third party.
SECTION 7 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, video, and audio are owned by MakePhotosAlive or its licensors and are protected by applicable intellectual property laws.
You may use the Services for your personal non-commercial use only. You must not reproduce, distribute, modify, or transmit any material from the Services without our prior written consent.
SECTION 8 - THIRD PARTY LINKS
The Services may contain links to third party websites. We are not responsible for the content, accuracy, or practices of any third party websites. Your use of third party websites is at your own risk.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
MakePhotosAlive is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make are made directly with MakePhotosAlive. Shopify is not responsible for any aspect of any sales between you and MakePhotosAlive. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MakePhotosAlive.

SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
